ENTERTAINMENT COMPANIES SETTLE COMPLAINT AGAINST RECORDTV.COM
Court Injunction Prohibits RecordTV.com Operator from Streaming Copyrighted Works Over Internet Site
Encino, CA (April 16, 2001)…Twelve motion picture and entertainment companies today announced a settlement agreement in the case against David Simon and his company RecordTV.com. Based on the settlement agreement, the court has entered an injunction against Simon enjoining him from streaming plaintiffs’ copyrighted works over the Internet and using plaintiffs’ trademarks to advertise his website. Simon must also pay plaintiffs’ $50,000 for legal fees incurred.
"Today’s announcement is another giant leap forward in creating a fair and equitable marketplace on the Internet for movies, TV shows and other copyrighted programming. RecordTV.com, by way of this settlement, confirms that streaming valuable creative works without permission is 100% wrong. This settlement should make clear that one cannot create a website that does not respect Copyright Law. Such protections make possible the continued enjoyment of all of the wondrous online entertainment offerings," said Jack Valenti, President and Chief Executive Officer of the Motion Picture Association of America.
The original complaint against RecordTV.com and its operator David Simon was filed on June 15, 2000, in the United States District Court for the Central District of California. Plaintiffs’ complaint asked the court to grant an injunction against RecordTV to stop the illegal copying, unauthorized performances and violation of trademark of U.S. copyrighted films and television programs owned by the plaintiffs.
The plaintiffs included in the complaint are Metro-Goldwyn-Mayer Studios Inc.; Disney Enterprises, Inc.; Twentieth Century Fox Film Corp.; Columbia Pictures Industries, Inc.; CPT Holdings, Inc.; Columbia Pictures Television Inc.; TriStar Television, Inc.; TriStar Pictures, Inc.; ELP Communications; Paramount Pictures Corporation; Universal City Studios, Inc. and Warner Bros.
